Heroin smuggling accused gets bail in 36 days: The accused has no prior record, the trial will be lengthy, and prolonged custody without conviction is against individual liberty.
A young man arrested with heroin in Chandigarh has been granted bail by the district court just 36 days later. However, while granting the bail, the court imposed six conditions and also required him to furnish bonds of ₹50,000 each. The court clarified that the quantity of narcotics seized from the accused falls under the 'medium category'. In such cases, the strict rules of Section 37 of the NDPS Act do not apply, and prolonged detention without conviction is a violation of personal liberty.
